Terms of Service
Last updated October 29, 2026
These terms govern your use of WaiverTrack. By creating an account or using the service, you agree to them. Please read them, especially the sections on billing, electronic signatures, and liability.
1. What WaiverTrack is
WaiverTrack is software that generates Texas statutory lien waiver forms, collects signatures, and keeps records of what was signed, when, and by whom.
We are not a law firm and we do not provide legal advice. The forms follow Texas Property Code § 53.284, but whether a particular waiver protects you depends on facts we do not evaluate.
2. Your account
You must give accurate information when you create an account and keep it current. You are responsible for activity under your account and for keeping your credentials secure.
If you invite team members, you are responsible for the access you grant them and for removing access when someone leaves your company.
3. Plans, billing, and trials
Paid plans are billed in advance through Stripe on the interval you select. Trials convert to a paid plan unless canceled before the trial ends.
Subscriptions renew automatically until canceled. You can cancel at any time from your billing settings, and access continues through the end of the paid period.
Founding member pricing is limited to the first 50 subscribing organizations and is locked for as long as that subscription stays active without lapsing.
4. Your content
You keep ownership of the project data, payment information, and documents you put into the app. You grant us the limited license needed to store, process, and display that content so the service works.
You confirm that you have the right to upload anything you upload, and that you have authority to send signature requests to the recipients you name.
5. Electronic signatures
Signature requests are issued and captured in line with the Electronic Signatures in Global and National Commerce Act and the Texas Uniform Electronic Transactions Act.
We record signer identity signals, timestamps, and a document hash for each completed signature packet. That record is evidence, not a guarantee that a signature will be upheld in every dispute.
6. Acceptable use
Do not use the service to send signature requests to people who have not agreed to receive them, to upload unlawful content, or to attempt to access another organization's data.
We may suspend an account that puts the service, other customers, or recipients at risk.
7. Data and retention
Signed waiver records and audit trails are retained while your account is active. If you close your account, we retain records as long as needed for legal, tax, and dispute purposes, then delete or anonymize them.
You can export project and waiver records from the app at any time on plans that include export.
8. Availability
We work to keep the service available and to give notice of planned maintenance. We do not guarantee uninterrupted service, and we are not responsible for delays caused by systems outside our control.
9. Limitation of liability
To the extent permitted by law, our total liability for any claim relating to the service is limited to the amount you paid us in the twelve months before the claim.
We are not liable for indirect, incidental, or consequential damages, including lost profits or lost lien rights.
10. Termination
You may stop using the service at any time. We may terminate an account that materially breaches these terms, after notice where practical.
Sections about content ownership, liability, and dispute resolution survive termination.
11. Governing law
These terms are governed by the laws of the State of Texas. Venue for any dispute lies in the state or federal courts located in Travis County, Texas.
12. Changes to these terms
If we change these terms materially, we will notify account administrators by email or in the app before the change takes effect. Continuing to use the service after that date means you accept the updated terms.
